Terms & Conditions of Party Bright

  1. Definitions
    • “The Customer” means organisation or person who purchases goods and services from the company.
    • “The Company” means Party Bright.
    • The “Goods” or “Hire items” are any items supplied by contract between the customer and Party Bright, regardless of ownership.
    • The “Contract” is any written or verbal agreement between Party Bright and the customer.
  2. General
    • These terms and conditions shall apply to all contracts for the supply of goods or services by the company to the customer.
    • All goods remain the property of Party Bright.
    • The company reserve the right to substitute any items as a result of circumstances beyond its control.
    • All goods, once signed for become the responsibility of the customer. By accepting these terms and conditions you are solely responsible for the hire items at all times throughout your hire, from delivery and set up to collection by us.
    • No substitute items shall be accepted by the company.
    • All prices are based on up to 24 hours hire period. Longer hire periods are available and will be agreed in writing at the time of order.
    • Our hire items are for indoor use only.
  3. Delivery, Set up & Collection
    • Delivery and collections will be charged as agreed at the time of order.
    • Delivery of the items includes set up at the venue. Once set up, the hire items should not be moved until collection, unless prior arrangements have been made.
    • Unless a suitable lift is available deliveries and collections shall only be made to the ground floor level that has reasonable access (at the driver’s discretion).
    • Delivery will be made on the day of your event and collection on the day after, at a mutually convenient time, subject to the venue requirements, unless agreed otherwise when booking the items.
    • Hired items must be available for collection at the delivery address, unless otherwise agreed in advance. Any additional expenses incurred to us where subsequent journeys and/or additional vehicles need to be used will be charged accordingly.
    • An approximate time for delivery and collection will be arranged. However. please note this can be subject to change dependent on other bookings and to suit venue staff. We will communicate times to you around 7 days prior to your event.
  4. Prices, Payment & Cancellation Fees
    • A quote shall be submitted by the company to the customer either in writing or verbally. All quoted prices are inclusive of VAT.
    • Acceptance of this quote either in writing or verbally becomes subject to cancellation fees. More than 28 days before your hire: 50% of initial deposit refunded. Less than 28 days before hire: no refund available.
    • Payment in part or in full of any quote to supply goods and or services herein referred to shall be deemed as acceptance of these Term & Conditions.
    • When placing an order a 50% deposit will be taken to reserve the goods, with the balance to be paid in cleared funds 14 days before the date of hire, unless otherwise arranged. Your items are not reserved until the deposit has been accepted by us. You will receive e-mail confirmation on receipt of your deposit and again on receipt of the remaining 50% balance.
    • We accept payment by electronic payment directly to our bank account or Paypal, unless otherwise arranged.
    • Payment of your deposit is deemed to be an instruction of your booking. Hire items can be added to your booking , subject to availability, up to 14 days before your event date. Items may also be changed for alternate ones, subject to availability, up to 14 days before your event. However, the value must not go below the agreed total hire value. If you wish to remove items from your order and do not wish to hire alternate items in exchange, no refunds or part refunds will be given. You will be invoiced for any additional hire value.
  5. Failure to pay for or return items/damages to our products
    • The customer shall pay the company for any repair or replacement of goods that are lost, stolen or damaged beyond reasonable repair.
    • The customer shall not attempt to sell or dispose of the goods.
    • Items that are not available for collection within an agreed time frame and where we have not made a prior arrangement with you, will be charged 50% of the hire value for each additional day that the items are not returned back to us. If this impacts our ability to supply items for another booking then you will be liable for the full value of the second booking, including delivery charges. Items that are not returned after an extended period of time will be charged at the full replacement value and we may pursue you legally for this cost.
      Items must not be left in an unattended or in an unsecured location.
  6. Liability & Indemnity
    • To the fullest extent, the company shall not be liable for any losses the customer may incur arising out of or in connection with the hire of goods.
    • The customer agrees to indemnify the company at all times in respect of claims by any person in relation to any injury, loss, and claim or expense arising out of or in connection with the use of the goods.
    • If monies due are not paid in full by the date of booking, we hold no responsibility to provide the hire and hold no liability in this circumstance.
  7. Termination of Hire/Hire refusal
    • The company reserves the right to terminate the contract immediately and repossess the goods at any time where the customer is in breach of these Terms & Conditions.
    • You the customer authorise the company to enter any property where the goods are being used in order to repossess such goods.
    • We have the right to refuse hire of our items if we feel that the items are not suited to the purpose of your hire, or if you, your company or your planned event contradicts our company ethos.
  8. Hire Item Condition
    • On delivery of our items you are agreeing that the items are in good condition and are as advertised. Any concerns regarding the condition or quality of the item should be raised immediately and no complaint will be valid at a later stage, or if inspection has not occurred upon delivery. Therefore you may not request a reduction or refund if inspection has not taken place.
    • Any damages, breakages or missing parts will be charged according to their full replacement value, including labour costs.
    • All hire items are designed for indoor use only. The lights are not to be used outdoors unless in a marquee or other waterproof covered area. Prior notice must be given to us when intending to use in such areas in order for us to make arrangements for floor coverings/stability of the products etc.
    • Hire items should be tested for functionality by the hirer prior to event usage.
